Why do you think your ex-wife wish you dead? Do you mean you had physical clashes with her or she really has threatened you.
It is very hard to survive if someone loses her status in the states, the immigration law has become stricter. You mentioned that your wife would prefer full custody of your child, if the case goes to the court, if your wife doesn't have a status, will the custody granted to your wife?
If you actually prefer freedom instead of your child, then you should sponser your ex-wife. If she doesn't have a status -- deported to China, you can't see your child; if she stays as an illegal allien, then it is not good for your child, a happier and finanically more sound enviornment is better for your child.
And here is another reason, to prevent your ex-wife jumping onto any bed of an American attempting to get married and obtain a legal status, that any American man might not be a good step father.
