I have been working as as expat since 1994. I have never heard that requirement. Theoratically, you can sign (you do not have to, if you do not need a work permit.) a labor contract and be renewable on annual basis. The labor contract is worth nothing but obtaining a work permit and work visa. It wouldn't really help you getting as much benifits as the local employess (but on other hand, why do you need their work comp, social security anyway?)
As for the the length of the contract, most companies i know is Shenzhen would NOT sign any permanent contract with an employee, local or foreign. Usually, a two year renewable is plenty.
By the way, relax on the so-called the labour law. There a too many holes in the law. I don't kown anyone taking it too seriously at this point. Labor union, for instance, is an example. The law requires any company more than 20 people having a union. But guess how many MNCs have followed the law?????
