it is normally safe to copy and sell it in China. Patents well drafted according to USPTO guidelines can hardly withstand invalidation proceedings in China, let along those already questioned in the US. Thus IPR should NOT be a major concern when it comes to copy a brand name drug from US. Rather, one should think very hard how to get the drug efficiently registered in China, given the wide spread corruption in the system. Of course, if one wants to only product raw material for foreign generic drug companies, that is another story.
Anyway, I think it is a great idea to produce "brand new" generic drugs in China. I am into it, so would be other people in the forum, including some experts like yourself and "风华正茂". Maybe we can work together and start doing something in China...
