1. Are you saying that patent challenge in China is a matter of formality? If so, how come we only see two such cases, viagra and avandia?
2. Regarding drug registration in China, is there any regulatory barrier? Or, what needs to be done other than pulling some strings?
And, Paragraph IV may not necessarilly mean invalidation. It's usually cheaper and more practical to design around patents, especially those pertaining to formulation. So the patent is still enforceable. That being said, all these only apply to the sitatuion in the US. Looks like our compatriots have been pretty creative in finding their own means. Viagra patent was invalidated based on a technicality, right?
